As of July 1, 2018 the Ontario Ministry of Housing will no longer be investigating complaints from residential rental tenants regarding property maintenance issues. On that date, all municipalities within Ontario will be required to either:
- enact a Property Standards By-Law, or
- have staff available/appointed to inspect complaints from residential rental tenants against the Maintenance Standards contained within the Residential Tenancies Act (RTA) and enforce those standards.
As per resolution 2018-073 ENFORCEMENT OF RESIDENTIAL TENANCIES ACT, Council hereby approves Report No. 2018CT-05 and further, that the authority to enforce the Residential Tenancies Act (RTA) standards is provided in the RTA and the Provincial Offences Act and requires municipalities to adopt a by-law appointing an inspector who shall be responsible for enforcing the Residential Tenancies Act.
By-Law 2018-013 appoints the Municipal Enforcement Officer as an inspector who shall be responsible for the enforcement of the Residential Tenancies Act and Ontario Regulation 517/06, as of July 1, 2018.
