By-Law 2004-015 - Roads Obstructing and Encumburing By-Law

BY-LAW NO.2004-015
AMENDMENT TO BY-LAW NO. 2000-003


BEING A BY-LAW TO PROHIBIT AND REGULATE THE OBSTRUCTING, ENCUMBERING, INJURING OR FOULING OF ROADWAYS, HIGHWAYS OR BRIDGES, AND TO PROHIBIT THE PLACING OR DEPOSITING OF ANY FIREWOOD OR ANY OTHER THING CALCULATED TO OBSTRUCT IT, ON ANY ROADWAY, HIGHWAY OR BRIDGE, AND FOR REQUIRING THE REMOVAL OF THEM BY THE PERSON BY WHOM THE SAME ARE OR WERE SO PLACED OR DEPOSITED.


WHEREAS the Municipal Act, 2001, c.25, Section 11(1) provides that a single-tier municipality may pass by-laws respecting matters within the Highways sphere of jurisdiction;
AND WHEREAS the Municipal Act 2001, c.25, Section 425(1) provides that by-laws may be passed by all municipalities and by police services boards for providing that any person who contravenes any by-law of the municipality or of the board, as the case may be, passed under this Act, is guilty of an offence;


NOW THEREFORE the Council of the Corporation of the Municipality of Calvin enacts as follows:
1. No person shall obstruct, encumber, injure or foul any roadway, highway or bridge within the Municipality of Calvin.


2. No person shall place or deposit on any roadway, highway or bridge any firewood or other thing calculated to obstruct them.


3. Any person found in default of this By-law shall be required to remove such items by whom the same are or were so placed or deposited and or repair or cause to be repaired any damages or injury done to any roadway, highway or bridge within the Municipality of Calvin.


4. Any person found in default of this By-law and who does not remove such items by whom the same are or were so placed or deposited, or who does not repair or cause to be repaired any damages done to any roadway, highway or bridge as requested by Council shall be subject to a fine of not to exceed five hundred ($500.00) and said fine shall be recoverable under the provisions of the Municipal Act 2001,c.25 Section 437(1);


5. Any previous by-laws or sections of by-laws conflicting with terms and provisions of this by-law shall be deemed to be and are repealed;


6. This by-law shall apply to the whole Municipality of Calvin in its entirety and shall come into force and effect as of the date of the final reading thereof.
